Terms of Service

The terms that apply when you buy, activate, and use SaintBackup software and the saintbackup.com website.

Effective date: November 9, 2026

These Terms are an agreement between you (the individual or organization using the software, "you" or "the customer") and [COMPANY NAME] ("SaintBackup," "we," or "us"). By creating an account, buying a license, installing, or using SaintBackup, you agree to these Terms. If you do not agree, please do not use the software.

1. About us

SaintBackup is a legal entity registered in Vietnam. We sell directly and have no resellers or distributors. Licenses are sold only through saintbackup.com.

2. The product

SaintBackup is backup software for MariaDB databases. It has two parts:

• Agent — free. It runs on your database server and creates the backups.
• Center — requires a license. It runs on your own machine and receives, stores, and manages the backups.

Backup data is end-to-end encrypted and stays on your machines. SaintBackup does not access the contents of your databases.

If you use connection method 3 — routing through SaintBackup's relay server (coming soon) — your backups pass through the relay and are stored there temporarily for up to 60 days, always in encrypted form. SaintBackup does not hold the keys and cannot decrypt this data.

3. Licenses

3.1. License plans

• Center licenses are sold as annual subscriptions with a term of 1, 2, or 3 years. There is no perpetual license.
• Each license includes 1 Agent seat. Additional Agent seats cost $30 per seat per year.
• Prices for each plan are shown on the website at the time of purchase.

3.2. Free trial

You can try SaintBackup free for 1 month with 1 Agent. After the trial, you need a license to keep using Center.

3.3. Serial Key

• After a successful payment, you receive a Serial Key.
• Each Serial Key can run on only 1 Center at a time.
• To move to a different machine, use the "Transfer machine" button in your account on the website.

3.4. Activation and offline use

• The first activation requires an internet connection to SaintBackup's license server.
• Once activated, the software keeps working if your machine goes offline or if SaintBackup's servers stop operating.

3.5. When a license expires

• We send a reminder email when 1 month remains on your license.
• After expiration, Center will not open its features (only the License page remains available so you can renew).
• Your backup files are not locked. You can still restore your data from them manually.

3.6. Adding Agent seats mid-term

If you buy additional seats while your license is active, you choose one of two options:

• Co-terminous renewal — the new seats and your existing license are aligned to the same expiration date.
• Current term — the new seats run until your license's current expiration date.

4. Payment

• We currently accept payment through PayPal. Other payment methods may be added later.
• Payments go to the bank account of [COMPANY NAME].
• PayPal processes your card details. SaintBackup does not store card numbers.

5. Refunds

• You can request a refund within [REFUND DAYS] days of payment by emailing support@saintbackup.com.
• Refunds are issued through PayPal.
• New purchases: when refunded, the related Serial Key is revoked and Center stops working under that license.
• Renewals or added seats: when refunded, your license term and number of Agent seats return to what they were before that purchase.

6. What you may not do

• Reverse engineer, decompile, disassemble, or try to obtain the source code of the software.
• Resell, rent, or redistribute the software or licenses.
• Share your Serial Key with others, or try to run one key on more than one Center at the same time.
• Tamper with or bypass the license checks.

If you violate these rules, we may revoke your Serial Key and suspend your account without a refund.

7. Usage statistics

Center sends a set of aggregate statistics to SaintBackup's servers once a day, used to operate licensing, provide technical support, and improve the product. These statistics do not include your data, database or table names, passwords, or encryption keys. The full list is in our Privacy Policy. By using the software, you agree to this collection.

8. AI Assistant (coming soon)

Starting with version 1.1, SaintBackup may include an AI Assistant to help troubleshoot issues. It works only when you choose to use it. When you do, logs and configuration (with secrets removed) are sent to an AI model provider for analysis.

9. Your responsibilities

• You are responsible for verifying that your backups meet your needs, including running restore tests regularly.
• You are responsible for keeping your account password, Serial Key, and encryption keys safe. If you lose your encryption key, SaintBackup cannot decrypt your backups.
• You are responsible for making sure the data you back up is lawful.

10. Warranty and limitation of liability

• To the extent permitted by law, the software is provided "as is," without any warranty that it is error-free or fit for any particular purpose.
• To the extent permitted by law, SaintBackup's total liability for any claim related to the software or services is limited to the amount you paid SaintBackup in the 12 months before the claim arose.
• To the extent permitted by law, SaintBackup is not liable for indirect damages such as lost profits, business interruption, or data loss.

11. Changes to these Terms

We may update these Terms from time to time. The new version will be posted on the website with its effective date. For significant changes, we will notify you at your registered email address. Continuing to use the software after the effective date means you accept the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of Vietnam. Both parties will first try to resolve any dispute through good-faith negotiation. If that fails, the dispute will be settled by a competent court in Ho Chi Minh City, Vietnam.

13. Language

These Terms are available in Vietnamese and English. If the two versions differ, the Vietnamese version is the original and prevails.
